Abstract

إن الإجهاض من إحدى الظواهر الاجتماعية التي لها حالاتها ودواÙعها، وهو يتعلق تعلقا وثيقا بالأحكام الشرعية، Ùالشريعة الإسلامية بدورها ÙÙŠ الحياة البشرية تأتي أحكامها بما يناسب البشر. ومن صور الإجهاض ÙÙŠ الواقع هو ما حصل من المرأة المجنونة أو الأم المجنونة للدواÙع الأخلاقية، هذه ظاهرة واقعية تكثر مع كثرة الÙتن ÙÙŠ هذا الزمان، إضاÙØ© إلى ضع٠الوازع الديني لدى المجتمع. بناء على هذا، يهتم الباحث بكتابة بحث يهد٠إلى معرÙØ© أحكام إجهاض الجنين ÙÙŠ هذه الحالة ÙÙŠ منظور الÙقه الإسلامي. والبحث مكتبي يعتمد على المنهج التحليلي. وبعد البحث والاطلاع، ظهر أهم نتائجه ما يلي : أن حكم الإجهاض للأم المجنونة للدواÙع الأخلاقية ÙÙŠ الÙقه الإسلامي تختل٠مع اختلا٠حالاته، حيث إن ارتكابه ÙÙŠ بعض الحالات يعتبر ممنوعا، ÙˆÙÙŠ بعض آخر يعتبر مما يباح Ùعله كآخر حل مع توÙر الضوابط والشروط Ùيه، وذلك للضرورة أو الحاجة تنزل منزلة الضرورة. الكلمات الرئيسية: إجهاض الجنين – الأم المجنونة – الدواÙع الأخلاقية - الÙقه الإسلامي
