Abstract

Sebagai sebuah perangkat metode berpikir rasional, ushul fiqh tidak murnidibangun atas landasan logika, melainkan juga didasarkan pada wahyu verbalseperti tersirat dalam dalil-dalil kulli ajaran agama. Para Juris Islam tidakmengadopsi logika formal begitu saja dalam merumuskan kaidah-kaidah ushulfiqh. Sebaliknya, mereka melakukan adaptasi dan perubahan menjadi sebuahlogika baru yang mencakup seluruh esensi nilai-nilai ajaran agama. Perpaduanwahyu dan logika ini yang membuat ushul fiqh survive dan tak mudah lekangdengan waktu, bahkan menarik perhatian untuk terus dikaji dimensi keilmuannya.Secara epistemologis, ushul fiqh merupakan teori ilmu yang memvokuskan padakerja penggalian hukum berdasar dalil-dalilnya. Ilmu ushul fiqh bukan lahir diruang yang kosong, melainkan hadir sesuai tantangan dan kebutuhan hukumyang mengemuka. Ilmu ushul fiqh dibangun untuk merumuskan kaidah-kaidahistinbath sehingga mampu melahirkan preskripsi hukum sesuai tingkat perubahandan perkembangan masyarakat.
